		<description><![CDATA[做人力资源管理，尤其是做劳动关系管理相关工作，必须要每天保持战战兢兢的工作态度。因为在每一项具体的工作中，都有各种层出不穷的法律风险。而企业又承担着很多的举证责任，因此这些风险又尤其容易爆发出来。 《劳动争议调解仲裁法》 第六条 发生劳动争议，当事人对自己提出的主张，有责任提供证据。与争议事项有关的证据属于用人单位掌握管理的，用人单位应当提供；用人单位不提供的，应当承担不利后果。 第三十九条 当事人提供的证据经查证属实的，仲裁庭应当将其作为认定事实的根据。劳动者无法提供由用人单位掌握管理的与仲裁请求有关的证据，仲裁庭可以要求用人单位在指定期限内提供。用人单位在指定期限内不提供的，应当承担不利后果。 今天在QQ上，一个刚刚开始做HR的朋友忽然之间问我：员工离职手续怎么办？猛然间的一个问题，而且是如此宽泛的一个问题，让我不知道如何回答…… 员工离职的形式 员工离职的原因有很多种，自然形式也有很多种，而从劳动关系管理的角度来，结合2008年1月1日实施的《劳动合同法》，我们可以把员工离职的形式分为以下几种类型： 1、员工主动离职（辞职）。员工因为个人的原因，通过递交辞职信或者辞职报告的形式要求离职。此种形式是在所有的员工离职形式中，企业的法律风险最小的，但是也是最容易被企业忽视风险的。 2、劳动合同到期终止。此种情况又分为两种：一种是劳动合同到期后企业决定不予续签，另外一种是劳动者本人提出不续签。在第一种情况下风险较多，但比较明显，且需要支付给劳动者经济补偿金，因此企业一般都很容易规避，但第二种情况往往企业会因为证据留存不足而留下隐患。 3、员工因”不胜任”被辞退。此种情况需要支付劳动者经济补偿金。 《劳动合同法》第四十条　有下列情形之一的，用人单位提前三十日以书面形式通知劳动者本人或者额外支付劳动者一个月工资后，可以解除劳动合同： （一）劳动者患病或者非因工负伤，在规定的医疗期满后不能从事原工作，也不能从事由用人单位另行安排的工作的； （二）劳动者不能胜任工作，经过培训或者调整工作岗位，仍不能胜任工作的； 4、员工因严重违纪等根据《劳动合同法》第三十九条规定的情形被辞退。此种情况不需要支付经济补偿金，但是在处理中如果不按照法定程序处理，将会有很大的风险。 《劳动合同法》第三十九条　劳动者有下列情形之一的，用人单位可以解除劳动合同： （一）在试用期间被证明不符合录用条件的； （二）严重违反用人单位的规章制度的； （三）严重失职，营私舞弊，给用人单位造成重大损害的； （四）劳动者同时与其他用人单位建立劳动关系，对完成本单位的工作任务造成严重影响，或者经用人单位提出，拒不改正的； （五）因本法第二十六条第一款第一项规定的情形致使劳动合同无效的； （六）被依法追究刑事责任的。 5、企业与员工协商解除劳动合同。此种情形企业需支付经济补偿金。 员工离职手续办理中注意事项 1、离职手续必须保证不违法。 2、离职手续必须时刻保留相应书面证据，所有的流程都需要相关责任人及劳动者签字确认。 3、对无法按法定要求办理的事项，需及时与劳动者协商并书面确认协商的结果。 各种形式的离职办理程序大同小异，但是又各有各的不同，今天，我们先来看一下其中最简单的员工辞职手续的办理流程。 员工辞职手续办理流程 1、员工提交辞职报告或辞职信。 这一环节貌似与企业无关，但是却是整个手续中最重要的，因为一封简单的辞职信，是整个手续办理的基本依据。而在实际中，已经有企业因为此环节的疏漏而遇到了麻烦。 我们收到的辞职信往往是洋洋洒洒几千言，往往一半以上的文字是对企业歌功颂德，另外一半的文字是表达自己离开公司的遗憾心情。但是作为劳动关系管理的人员，我们应该在这几千言的辞职信里面搜集什么信息呢？辞职的原因当然是一方面，有利于企业今后对人员流动的分析，但是更重要的是我们要得到 员工本人辞职的证据，在辞职信中应包含以下三点： （1）员工本人辞职的意愿。员工洋洋洒洒写了很多，但是没有一个字表明自己是辞职的，那这封信就不叫辞职信，或者只能算做一封离职说明。 （2）员工本人的签字。有的时候员工交过来的辞职信是打印版的，最后的落款也是打印出来的，或者有的是员工的辞职信在交到人力资源部的时候就已经签过字了。这个时候一定要让劳动者当面再重新签一遍字或者按一个手印进行确认。 （3）辞职日期。这个日期是辞职信送达的日期，而不是辞职信的落款日期。根据劳动合同法规定，劳动者提出辞职后，企业应该在30天内为其办理离职手续。当然，如果人力资源部接到的辞职信的日期如果早于当前日期，可以要求劳动者重新签字并标明当前日期。 《劳动合同法》第三十七条　劳动者提前三十日以书面形式通知用人单位，可以解除劳动合同。劳动者在试用期内提前三日通知用人单位，可以解除劳动合同。 以上三点是必不可少的条件，如果无法取得以上信息的全部，企业可能会被劳动者讹诈。曾经就有公司因为未确认劳动者辞职报告中的本人签字，劳动者在离职后提出企业应按照辞退或协商解除等形式支付经济补偿金，最终企业败诉。 如果是被劳动者讹诈败诉，给企业带来经济损失，那这样的HR只能是”下课”一种后果了。 &#8230;<table class="wumii-related-items" cellspacing="0" cellpadding="3" border="0"  style="clear: both;">

<p>今天在QQ上，一个刚刚开始做HR的朋友忽然之间问我：员工离职手续怎么办？猛然间的一个问题，而且是如此宽泛的一个问题，让我不知道如何回答……</p>
<p style="BACKGROUND: rgb(127,255,0); MARGIN-BOTTOM: 5pt; “MARGIN-TOP: 5pt"><strong>员工离职的形式</strong></p>
<p>员工离职的原因有很多种，自然形式也有很多种，而从劳动关系管理的角度来，结合2008年1月1日实施的《劳动合同法》，我们可以把员工离职的形式分为以下几种类型：</p>
<p><strong>1、员工主动离职（辞职）。</strong>员工因为个人的原因，通过递交辞职信或者辞职报告的形式要求离职。此种形式是在所有的员工离职形式中，企业的法律风险最小的，但是也是最容易被企业忽视风险的。</p>
<p><strong>2、劳动合同到期终止。</strong>此种情况又分为两种：一种是劳动合同到期后企业决定不予续签，另外一种是劳动者本人提出不续签。在第一种情况下风险较多，但比较明显，且需要支付给劳动者经济补偿金，因此企业一般都很容易规避，但第二种情况往往企业会因为证据留存不足而留下隐患。</p>
<p><strong>3、员工因”不胜任”被辞退。</strong>此种情况需要支付劳动者经济补偿金。</p>

<p>4、员工因严重违纪等根据《劳动合同法》第三十九条规定的情形被辞退。此种情况不需要支付经济补偿金，但是在处理中如果不按照法定程序处理，将会有很大的风险。</p>

<p><strong>5、企业与员工协商解除劳动合同。</strong>此种情形企业需支付经济补偿金。</p>

<p>1、离职手续必须保证不违法。</p>
<p>2、离职手续必须时刻保留相应书面证据，所有的流程都需要相关责任人及劳动者签字确认。</p>
<p>3、对无法按法定要求办理的事项，需及时与劳动者协商并书面确认协商的结果。</p>
<p><span><span style="FONT-FAMILY: 楷体_GB2312"><span>各种形式的离职办理程序大同小异，但是又各有各的不同，今天，我们先来看一下其中最简单的员工辞职手续的办理流程</span></span>。</span></p>

<p><strong>1、员工提交辞职报告或辞职信。</strong></p>
<p>这一环节貌似与企业无关，但是却是整个手续中最重要的，因为一封简单的辞职信，是整个手续办理的基本依据。而在实际中，已经有企业因为此环节的疏漏而遇到了麻烦。</p>
<p>我们收到的辞职信往往是洋洋洒洒几千言，往往一半以上的文字是对企业歌功颂德，另外一半的文字是表达自己离开公司的遗憾心情。但是作为劳动关系管理的人员，我们应该在这几千言的辞职信里面搜集什么信息呢？辞职的原因当然是一方面，有利于企业今后对人员流动的分析，但是更重要的是我们要得到 <strong>员工本人辞职的证据</strong>，在辞职信中应包含以下三点：</p>
<p>（1）员工本人辞职的意愿。员工洋洋洒洒写了很多，但是没有一个字表明自己是辞职的，那这封信就不叫辞职信，或者只能算做一封离职说明。</p>
<p>（2）员工本人的签字。有的时候员工交过来的辞职信是打印版的，最后的落款也是打印出来的，或者有的是员工的辞职信在交到人力资源部的时候就已经签过字了。这个时候一定要让劳动者当面再重新签一遍字或者按一个手印进行确认。</p>
<p>（3）辞职日期。这个日期是辞职信送达的日期，而不是辞职信的落款日期。根据劳动合同法规定，劳动者提出辞职后，企业应该在30天内为其办理离职手续。当然，如果人力资源部接到的辞职信的日期如果早于当前日期，可以要求劳动者重新签字并标明当前日期。</p>

<p>以上三点是必不可少的条件，如果无法取得以上信息的全部，企业可能会被劳动者讹诈。曾经就有公司因为未确认劳动者辞职报告中的本人签字，劳动者在离职后提出企业应按照辞退或协商解除等形式支付经济补偿金，最终企业败诉。</p>
<p>如果是被劳动者讹诈败诉，给企业带来经济损失，那这样的HR只能是”下课”一种后果了。</p>
<p><strong>2、离职手续办理。</strong></p>
<p>离职手续应该包含2个方面：离职审批和离职交接。而不管是何种离职原因，员工一旦确定要离职，大部分不希望继续在企业待太久，因此离职手续的设计要在保证企业利益的情况下，尽可能简化。当然，法律也是规定了劳动者有工作交接的义务，而且对劳动者的交接义务也有一定的限制（第五十条：用人单位依照本法有关规定应当向劳动者支付经济补偿的，在办结工作交接时支付。）</p>

<p>　　劳动者应当按照双方约定，办理工作交接。用人单位依照本法有关规定应当向劳动者支付经济补偿的，在办结工作交接时支付。</p>
<p>　　用人单位对已经解除或者终止的劳动合同的文本，至少保存二年备查。</p>

<p>注1：或许大家注意到了，在离职清单中并没有关于工资核算、经济补偿金支付的内容。原因是职工薪酬的支付在我们公司流程相对较复杂，做HR的朋友应该可以理解这个问题，因此我会在最终的《离职告知书》中与员工约定工资和经济补偿金的支付按照正常的工资支付周期和时间进行支付，并由员工确认签字。</p>

<p>注3：根据各自企业的情况，HR应该提前了解离职手续办理所耗费的时间，并提前通知劳动者进行办理，以免延误而导致不必要的麻烦。而比较耗费时间的主要包括年休假、加班补休、职业病健康体检（一般取得结果需要2天左右的时间）</p>

<p><strong>1、目前为止，我国社会仍处于劳动力相对过剩阶段</strong>（劳动力过剩和人才短缺是不相悖的，关于人才短缺，以后有机会与大家探讨），因此在招聘过程中，用人单位处于相对强势地位，所以可以对求职者提出各种“苛刻”或者不相关的要求。这也就是为什么法律明令禁止在用工时扣押劳动者证件或者要求缴纳各种形式的押金，而劳动者也明明知道这些行为是违法的，却依然为了能有一份工作而上交自己的证件或者押金。</p>
<p><strong>2、很多企业的HR并不懂法，甚至是懂法而不守法。</strong>很多时候，法律是做任何事情的底线。而在国内目前的情况下，很多企业的HR有一种高高在上的感觉，认为自己代表的企业是恩施工作机会的救世主一样，而在劳动监察部门执法不力或者无力执法的情况下，HR们根本就没有必要学习这些劳动法规。2007年底闹得沸沸扬扬的《劳动合同法》就是如此，在2008年1月1日前HR们如临大敌，而到了2008年1月1日之后，HR们却发现，情况好像跟之前没有什么差别，于是也就不再去研究了。</p>
<p>而且国内劳动法律的要求也高于应聘者的期望（应聘者的期望首先是找到一份工作，可以有钱赚，而至于有没有劳动合同、有没有缴纳社保都可以暂且不顾），即使HR懂得劳动法律法规的要求，从降低企业成本的角度，也没有必要去按照法规来执行。</p>
<p><strong>3、劳动者维权意识不强。</strong></p>
<p>一方面，劳动者对这方面的法律法规知之甚少，有的连劳动合同法的内容都不清楚，更别提更加偏僻的《就业促进法》了。另一方面，很多人在经历这样的遭遇之后，往往也不知道应该如何处理，只能是自认倒霉或者是怨自己的父母没有把自己生成一个男孩、女孩、美女、帅哥、高个子、矮个子……</p>
<p>企业就业歧视了，而劳动者也没有什么反应，HR们肯定也就不会再在意这些“歧视”问题，从而愈演愈烈，用更多的类似条件去筛选应聘者。</p>
<p><strong><font size="4">面对“就业歧视”，劳动者应该如何做？</font></strong></p>
<p>维权，一定要维权。通过维权让那些不良的HR们知道不依法行事的成本。</p>
<p>根据《就业促进法》第六十二条的规定</p>
<blockquote><p>违反本法规定，实施就业歧视的，劳动者可以向人民法院提起诉讼。</p>
</blockquote>
<p>第六十八条的规定：</p>
<blockquote><p>违反本法规定，侵害劳动者合法权益，造成财产损失或者其他损害的，依法承担民事责任；构成犯罪的，依法追究刑事责任。</p>
</blockquote>
<p>劳动者在受到就业歧视时，可以向人民法院提起诉讼，而在诉讼中的诉求可以包括求职过程中发生的各种费用、因就业歧视而导致的其他机会成本（例如因为了面试、入职体检等从原单位辞职或拒绝了其他单位的offer而给个人带来的损失）以及因受到歧视而带来的精神损伤的补偿费。</p>
<p>当然，如果真正进入了诉讼程序，具体的诉求还是要咨询律师。</p>
<p>希望所有的劳动者都能享受到平等就业的权利，同时，也希望所有的HR同仁们可以知法、懂法、守法、宣传法律法规。</p>
